NEWTON, NJ (Sussex County) – A Pennsylvania man was sentenced after he was convicted by a jury on charges that stemmed from a Christmas Eve road rage incident that occurred over two years ago, according to Sussex County prosecutor Francis Koch.
Daniel Ziolkowski, 54, of Dingmans Ferry was sentenced by Honorable N. Peter Conforti, J.S.C., at the Sussex County Courthouse in Newton on August 1.
On December 24, 2014, Ziolkowski was operating his motor vehicle in a westerly direction on Layton Road in Sandyston Township. On two occasions, he allegedly “brake-checked” the car following to his rear, coming to a complete stop in front of the following car after the second occasion.
Ziolkowski then exited his vehicle and while brandishing a knife approached the following vehicle yelling and screaming at the driver. While continuing to yell and scream at the driver, he allegedly caused damage to the driver’s door with his lower body and caused further damage by using the knife to stab the windshield and to slash and flatten the left front tire.
Ziolkowski then re-entered his vehicle and fled from the scene.
According to Koch, Zikolkowski was convicted on May 31, after a jury trial to third-degree possession of a weapon for an unlawful purpose, fourth-degree unlawful possession of a weapon, fourth-degree criminal mischief and two counts of harassment.
Ziolkowski was sentenced to three years of probation and 210 days in jail with credit for one day time served. His driver license was ordered suspended for three months. He was ordered to successfully complete an anger management program, submit a DNA sample at his own expense, have no contact with the victim, and pay restitution of $31.50 and fines and fees totaling $555.00.
