Two charged during traffic stop in Newton; 1 for crack cocaine, 1 for urinating

NEWTON, N.J. (Sussex County) – Two Newton men were arrested after one was allegedly intoxicated and the other for urinating on the vehicle.

On Thursday, November 10 at 10:21 p.m., Newton Police received a 9-1-1 call for an erratic driver on Water Street.  Officers located the vehicle in question and conducted a motor vehicle stop on Main Street, police said.

During their investigation, the driver of the vehicle was identified as Tannis D. Posey, 40, of Newton, NJ and he displayed signs of being intoxicated and was placed under arrest, police said.

After Posey was told that he was under arrest, he attempted to pull away from the officers to not be handcuffed and physically resisted while being placed into custody.  A search of Posey’s person after the arrest revealed that he was in possession of 10 vials of suspected crack cocaine, police said.

While officers were conducting the investigation with Posey, the passenger, who was identified as Greggory Garrett, 53, of Newton, NJ, proceeded to urinate on the vehicle and became irate with the officers on scene, police said.

Garrett continued to yell at the officers and interfered with the investigation when he attempted to push pass them and he was then placed under arrest for obstruction, police said.

Posey was charged with third degree possession of a controlled dangerous substance, disorderly persons offense resisting arrest, failure to use turn signal, driving while suspended, driving while intoxicated, refusal to submit breath samples, open container of an alcoholic beverage in a motor vehicle and possession of CDS in a motor vehicle.

Garrett was charged with disorderly persons offense obstructing administration of law and urinating in public.

Posey and Garrett were released pending an appearance in Superior Court.
