N.J. man charged with burglary, theft in Newton

NEWTON, NJ (Sussex County) – A Wantage man is facing numerous charges after he allegedly stole a cigarette lighter and a wallet Wednesday evening.

Shayne Divito, 21, was charged with third-degree burglary, two counts of theft of movable property, third-degree possession of Ativan and fourth-degree resisting arrest.

At 6:33 p.m., town police were dispatched to the area of 271 Spring Street for a report of an unknown male who had entered an occupied apartment without permission or consent, police said.

When officers arrived, they located Divito matching the provided description across the street, police said.

A police investigation revealed that Divito was under the influence and had not only entered the victim’s apartment and stole a cigarette lighter from the resident’s pocketbook, but had also stolen a wallet from another victim’s unlocked motor vehicle which that was parked in a lot across the street, police said.

The cigarette lighter, the wallet and all of its contents were recovered and returned to their owners, police said.

As officers took Divito into custody, he resisted arrest by attempting to flee before being subdued and arrested, police said.

A search incident to arrest led to the discovery of a small blue bottle that contained 42 Ativan pills for which Divito did not possess a prescription, police said.

Divito was processed and released pending a mandatory appearance in Sussex County Superior Court.
